Privacy Policy

1. Introduction
AG/ES ("AG/ES", "we", "us", or "our") is a quiet-luxury essentials house. This Privacy Policy describes — calmly, plainly, and in full — how we collect, use, share, store, retain, and protect the personal information of visitors, customers, concierge enquirers, and subscribers ("you") when you interact with the AG/ES website, our concierge channels (WhatsApp, Instagram, email, telephone), the AG/ES Concierge AI assistant, and any related services (collectively, the "Services").
We have written this policy in clear language because trust is foundational to the house. AG/ES treats personal information as a quiet responsibility, not a commercial asset. By accessing or using the Services, you consent to the collection and use of your personal information as described in this Privacy Policy. If you do not consent, please discontinue use of the Services and contact the house if you would like prior interactions reviewed.
This policy is published in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and, to the extent applicable, India's Digital Personal Data Protection Act, 2023 ("DPDP Act"). Where you reside in a jurisdiction with additional privacy laws (such as the EU GDPR or the UK GDPR), the relevant additional rights and protections set out in those laws also apply, and the relevant supplementary sections below should be read together with the general provisions.
2. Scope
This Privacy Policy applies to all personal information collected through the Services, regardless of channel. It does not apply to third-party websites, applications, or services that may be linked from the Services. Those third parties operate under their own privacy policies, which we encourage you to review carefully.
This policy applies to: (i) browsers of the AG/ES website; (ii) customers placing orders via concierge channels; (iii) subscribers to AG/ES newsletters; (iv) users of the AG/ES Concierge AI assistant; (v) individuals who contact AG/ES via WhatsApp at +91 70393 60331, Instagram at @theageswear, email at clothingages@gmail.com, or telephone; and (vi) any other person who interacts with the Services in any manner.
3. Information We Collect
We collect personal information that you voluntarily provide, information collected automatically through your use of the Services, and information from third-party sources where lawfully permitted.
Information you provide directly may include: your full name, postal address, billing address, shipping address, email address, telephone number, WhatsApp number, Instagram handle, sizing preferences, fit feedback, gift-recipient details (where you ask us to ship to a third party), payment-instrument metadata (such as last four digits and instrument type, but not full card numbers), order details, return reasons, concierge chat transcripts, AI-concierge prompts and responses, newsletter preferences, and any other information you choose to share with us.
Information collected automatically may include: device type, operating system, browser type and version, screen resolution, language preference, IP address (used in coarse form for security and analytics), approximate location derived from IP, pages visited within the Services, referring page, time spent on pages, interaction events (such as clicks, scrolls, and CTA selections), cart and wishlist behaviour, and error logs.
Information from third parties may include: information from payment processors confirming the status of a transaction; information from logistics partners regarding shipping and delivery; publicly available information from social platforms where you tag, mention, or message AG/ES; and information from advertising or analytics partners that we may engage subject to applicable law and your consent.
We do not knowingly collect sensitive personal information (such as health, biometric, genetic, financial-account credentials, religious belief, political opinion, sexual orientation, or caste) unless strictly required for a defined and lawful purpose. Where such data is unavoidably required, we will obtain your explicit consent.
4. How We Use Your Information
We use personal information only for the purposes for which it was collected, including: (a) processing and fulfilling your orders, including communicating dispatch, delivery, returns, and refunds; (b) operating and improving the Services, including diagnosing technical issues, monitoring performance, and developing new features; (c) personalising your experience, such as remembering sizing preferences and offering relevant editorial content; (d) communicating with you about your enquiries, orders, and concierge conversations; (e) sending newsletters, look-book releases, and campaign announcements where you have subscribed, with an unsubscribe option always available; (f) preventing, detecting, and investigating fraud, abuse, security incidents, and violations of our Terms of Service; (g) operating the AG/ES Concierge AI assistant so that it may respond meaningfully to your queries; (h) complying with legal obligations, tax obligations, regulatory requests, and lawful orders from competent authorities; and (i) protecting the rights, property, and safety of AG/ES, our customers, and the public.
We do not sell your personal information. We do not rent your personal information. We do not auction your contact data to third parties. We do not enable hidden third-party trackers to harvest behavioural profiles for resale.
5. Legal Bases (Where Applicable)
Where the EU GDPR, the UK GDPR, or another similar law applies to you, AG/ES relies on the following legal bases: (i) performance of a contract — to process orders, fulfil shipments, and respond to concierge enquiries; (ii) legitimate interests — to operate, secure, and improve the Services, conduct analytics, and prevent fraud, in each case balanced against your fundamental rights and freedoms; (iii) consent — to send marketing communications, run optional analytics or advertising cookies, and process any sensitive personal data; and (iv) legal obligation — to comply with tax, accounting, and regulatory requirements.
Where consent is the legal basis, you may withdraw consent at any time by contacting clothingages@gmail.com. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
6. The AG/ES Concierge AI Assistant
The AG/ES Concierge AI assistant is a conversational interface powered by third-party large-language-model technology. When you interact with the Concierge, the content of your message is transmitted to our AI gateway and the underlying model provider to generate a response.
We design the Concierge to minimise personal information collection. We strongly recommend that you do not share sensitive personal data — such as full payment-card details, identity-document numbers, passwords, health data, or third-party private information — in the chat. The Concierge is intended for general questions about fits, fabrics, sizing, care, availability, and the house philosophy.
Conversations with the Concierge may be logged in aggregated, de-identified form for the purposes of quality assurance, safety review, and improvement of the assistant. Where we retain identifiable transcripts (for example, to follow up on an enquiry), they are stored securely and access is restricted to authorised personnel.
The Concierge does not perform binding transactions, accept payment, or confirm orders. Purchase intent expressed through the Concierge is routed to human concierge channels for confirmation.
7. Cookies, Local Storage & Similar Technologies
AG/ES uses cookies, local storage entries, and similar technologies to operate the Services. We categorise these as: (a) strictly necessary — required for the Services to function, such as session integrity, security, and basic state; (b) preferences — to remember choices such as preferred language or saved sizing; (c) analytics — to understand aggregate, de-identified usage patterns and improve the Services; and (d) marketing — to measure the effectiveness of campaigns where we run them, only with your consent where required.
Where applicable law requires a consent banner, you will be offered clear choices to accept, reject, or customise non-essential cookies. You can also control cookies via your browser settings. Disabling certain cookies may degrade aspects of your experience.
8. Sharing & Disclosure
AG/ES shares personal information only as necessary to operate the Services, and always under appropriate contractual and technical safeguards. Categories of recipients include: (i) payment processors, to handle transactions securely; (ii) logistics partners, to dispatch and deliver orders; (iii) hosting, infrastructure, analytics, and security providers, to operate the website and protect it from threats; (iv) AI gateway and model providers, to deliver the Concierge experience; (v) communication providers such as WhatsApp Business and email service providers; (vi) professional advisers, including legal, accounting, and audit professionals, where required; and (vii) governmental, regulatory, or law-enforcement authorities, where compelled by valid legal process or where we believe in good faith that disclosure is required to protect rights, property, or safety.
In the event of a corporate transaction — including a merger, acquisition, restructuring, financing, or sale of all or part of the business — personal information may be transferred to the acquiring or surviving entity, subject to commitments at least as protective as those described in this policy. You will be notified of any material changes in ownership or use as required by law.
9. International Transfers
AG/ES is headquartered in India. To operate the Services we may transfer personal information to, store it in, and process it in countries other than your country of residence, including jurisdictions whose data-protection laws may differ. Where we transfer personal data outside its country of origin, we rely on lawful transfer mechanisms such as appropriate contractual clauses, adequacy decisions where available, and additional safeguards as appropriate.
10. Data Retention
We retain personal information only for as long as necessary to fulfil the purposes described in this policy, to comply with our legal, tax, and accounting obligations, to resolve disputes, to enforce our agreements, and to maintain the integrity of our records.
Indicative retention periods are: order and tax records — retained for the period required by Indian tax and accounting laws (typically eight years); concierge chat transcripts — retained for up to three years for service-quality purposes; newsletter subscription data — retained until you unsubscribe or request deletion; AI Concierge logs in identifiable form — typically retained for up to twelve months for safety review; security logs — retained for up to twenty-four months. After retention periods lapse, data is securely deleted or de-identified.
11. Security
AG/ES implements reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorised access, alteration, disclosure, or destruction. Measures include: encrypted transport (HTTPS/TLS), encrypted storage where applicable, restricted access on a need-to-know basis, audit logging, secure development practices, regular reviews of third-party processors, and incident-response procedures.
No method of transmission or storage is one-hundred-per-cent secure. You acknowledge that any transmission of personal information is at your own risk and that you are responsible for safeguarding the credentials and devices you use to access the Services.
In the event of a personal data breach that is likely to affect your rights, we will notify the relevant supervisory authority and, where required, affected individuals, in line with applicable law.
12. Your Rights
Subject to applicable law, you have the right to: (a) confirm whether AG/ES processes personal information about you and obtain access to such information; (b) request correction of inaccurate or outdated personal information; (c) request erasure of personal information where it is no longer necessary, where consent is withdrawn, or where processing is unlawful; (d) restrict or object to certain processing; (e) request portability of personal information you have provided to us; (f) withdraw consent where processing is based on consent; (g) opt out of marketing communications at any time; and (h) lodge a complaint with the competent data-protection authority in your jurisdiction.

13. Children
The Services are intended for individuals aged eighteen (18) years and above. AG/ES does not knowingly collect personal information from minors. If we become aware that personal information of a minor has been collected without verifiable parental or guardian consent (where applicable), we will take reasonable steps to delete that information.

14. Marketing Communications
Where you have subscribed to the AG/ES newsletter or otherwise opted in to marketing, we may send you editorial dispatches, look-book releases, campaign announcements, and considered product news. Each marketing communication includes a clear opt-out link or instruction. Withdrawing from marketing does not affect transactional messages required to fulfil your orders and concierge enquiries.
15. Automated Processing & Profiling
AG/ES does not currently make solely automated decisions that produce legal effects concerning you or significantly affect you. Where we adopt such practices in future (for example, advanced fraud detection), we will update this policy and provide additional information about your rights regarding automated decision-making.
16. Third-Party Platforms
When you interact with AG/ES via WhatsApp, Instagram, email, or other third-party platforms, your interactions are also subject to the privacy practices of those platforms. AG/ES is not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of each platform you use.
17. Region-Specific Disclosures
India — Under the DPDP Act, you have the right to access, correct, complete, update, and erase your personal data, the right to grievance redressal, and the right to nominate another individual to exercise your rights in case of incapacity or death. European Economic Area and United Kingdom — In addition to the rights described above, you may have the right to object to processing based on legitimate interests, the right to data portability for data you have provided to us under consent or contract, and the right to lodge a complaint with your local supervisory authority.
Where applicable laws in other jurisdictions provide additional rights, AG/ES respects those rights to the extent they apply to our processing of your personal information.
18. Changes to This Policy
AG/ES may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. The most current version will always be published on the Services with the updated effective date. Where changes are material, we will provide reasonable notice through the Services or by other appropriate means.
